Jonathan C. Hess was "driving erratically" on Route 72 in Lancaster County on Saturday, Oct. 5 when Manheim Borough Police pulled him over, according to the affidavit of probable cause.
Lancaster County Wide Communications Dispatched told officers, he "hit a divider" before swerving into an oncoming traffic, as stated in the affidavit.
When officers approached Hess, he had glassy and bloodshot eyes and smelled of alcohol, as detailed by police in the affidavit.
When asked how much he had to drink, he told them "a few beers," as stated in the affidavit.
He failed a field sobriety test and his blood alcohol content reportedly was 0.219%, the PA legal limit in .08%.
His preliminary arraignment was held on Thursday, Oct. 31 before Judge David L. Ashworth and he was release on his own recognizance, according to his court docket.
There are court dates listed for November but the case status is marked "closed".
